공증 (공정증서)

공증 하려고 하는 내용을 공증인이 직접 작성한 증서로서 약속어음, 수표, 금전소비대차, 동산양도담보부금전소비대차 등은 채무불이행 시 즉시 강제집행이 가능하나 유언공증 등에는 강제집행력이 없다고 할 수 있다.

1) 공증 은 작성일로부터 7일이 경화해야만 집행문을 부여 받을 수 있다.

2)계약내용이 복잡하거나 집행권원을 받아둘 필요가 있을 때 ‘공증’을 작성하도록 한다.

 

인증 (사서증서의 인증)

거래당사자가 작성한 계약서 등에 공증인이 확인한 것을 인증이라고 한다. 증서의 진정성립과 내용에 증거력만 있다.

채권양도 등 계약내용에 대한 제3자의 권리침해 예상 시 인증을 할 필요성이 있다.

 

확정일자

거래당사자가 작성한 계약서 등에 공증인이 확정이자 인을 찍은 것으로서 문서에 작성날짜에 대하여 증거력이 있다.

주거용 임대차계약 시 중요한 계약의 작성 날짜가 문제 될 가능성이 있는 경우에는 확정일자를 받아야 한다.

 

비고

채권자의 입장에서는 공증 ▶ 인증 ▶ 확정일자 순으로 채권보전에 안전하나 절차가 복잡하고 비용이 많이 든다는 단점이 발생한다.
